"The Krazy Big Fix" Sweepstakes
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. THIS SWEEPSTAKES IS BEING OFFERED ONLY IN THE UNITED STATES AND IS INTENDED FOR VIEWING IN THE UNITED STATES ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW.
Entry Period: The "The Krazy Big Fix" Sweepstakes ("Sweepstakes") will begin at 12:00 a.m. Eastern Time ("ET") on March 18, 2013 and end at 11:59:59 p.m. ET on December 31, 2013 ("Entry Period").
Agreement to Official Rules: Participation in the Sweepstakes constitutes Entrant's full and unconditional agreement to these Official Rules, and Sponsor's and Administrator's decisions, which are final and binding in all matters related to the Sweepstakes. Winning is contingent upon fulfilling all requirements set forth herein.
Sponsor: The Sweepstakes is sponsored by Elmer's Products Inc., 460 Polaris Parkway, Suite 5, Westerville, Ohio 43082 ("Sponsor").
Administrator: The Sweepstakes will be administered by American Sweepstakes & Promotion Co. Inc. 300 State Street, Suite 402, Rochester, NY 14614 (the "Administrator")
at the time of entry
Eligibility: The Sweepstakes is open and offered only to legal residents of the 50 United States and Washington, D.C., who are at least 18 years of age and have reached the age of majority in his or her state of residence at the time of entry. Employees, officers and directors of Sponsor, SBC Advertising, and American Sweepstakes & Promotion Co., their respective parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfillment and marketing agencies (collectively the "Released Parties"), their immediate families (including parents, children - whether step children or adoptive children or biological children, siblings, spouses and in-laws) and persons living in the same household (whether related or not) are not eligible to participate in the Sweepstakes. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited or restricted by law, rule or regulation.
Sweepstakes Entry: To enter the Sweepstakes through one of the methods of entry, Entrants must provide a photo or description of something they fixed with KRAZY GLUE® adhesive (a "Krazy Glue Fix"). Whether your submitted picture or description qualifies as a Krazy Glue Fix will be in Sponsor's or Administrator's sole discretion; however, the winners will be chosen by random drawing and the photos or descriptions of Krazy Glue Fixes will not be scored, judged or otherwise evaluated.
Entry Restrictions: Sponsor or Administrator reserves the right to disqualify any entry that includes content that contains or appears to contain:
- Anyone or anything being put at risk;
- Depictions of brand names or trademarks;
- Material that violates or infringes another person’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
- Endorsement of (or condones) illegal drug use, alcohol abuse, or other illegal activity;
- Nudity, profanity, violence or obscene material each of which may be evaluated by the sponsor based on context and societal acceptability;
- Material that is hateful, tortuous, defamatory, slanderous or libelous;
- Any derogatory characterization of any person or group based on race, color, gender, gender identity and expression, sexual orientation, religious beliefs, marital status, mental or physical disability, citizenship, creed, national origin, physical appearance, political affiliation, union membership or other unethical or unlawful factors;
- Personal information such as names, phone numbers, personal addresses, email addresses etc. should not be shown in or displayed in the entry; and
- Depictions of any conduct, language, or other context deemed inappropriate by the Sponsor or Administrator in their sole discretion.
Four Ways to Enter: Eligible entrants can enter the Sweepstakes through any of the following four (4) methods of entry:
- Online Entry: Enter online by visiting www.krazybigfix.com ("Website") and click the SUBMIT YOUR FIX button. Follow the instructions to complete all the requested information and submit it during the Entry Period ("Online Entry"). If you meet the eligibility requirements for the Sweepstakes, your online entry will be counted as one (1) entry.
- Twitter Entry: Using your Twitter account, go to the Krazy Glue Twitter page. (https://twitter.com/krazygluexpert). Tweet your Krazy Glue Fix using the hashtag #krazybigfix. If you meet the eligibility requirements for the Sweepstakes, your tweet will be counted as one (1) entry. All tweets must contain the hashtag, #krazybigfix in order to be counted as a valid Entry. By entering using Twitter, you consent Sponsor's announcement of your name as a winner or potential winner through Twitter. A retweet does not constitute an Twitter Entry. Any Entrant found to be using multiple Twitter accounts to enter the Sweepstakes may be disqualified. In addition, Entrants must enter the Sweepstakes using a personally-registered Twitter handle. Any Entrant found to be using the Twitter handle of a group, company, or other association, may be disqualified.
- Instagram Entry: Eligible entrants can enter the Sweepstakes by uploading a photo of their Krazy Glue Fix to Instagram. All photo submissions must include the hashtag, #krazybigfix. Once submitted, an entry cannot be deleted, canceled, or modified. If you meet the eligibility requirements for the Sweepstakes, your Instagram upload will be counted as one (1) entry. Any violation or attempt to violate this restriction may cause Sponsor to disqualify all of such person's eligible entries
- Mobile SMS Entry: To enter by text message, participants must have a text message capable phone and text the keyword "KRAZY" to the short code "74642" on their phone during the Entry Period. Upon receiving a verification message entrants will be prompted to enter their photo or description of their Krazy Glue Fix and a valid email address to be eligible for the prize drawing. If you meet the eligibility requirements for the Sweepstakes, your submission of your Krazy Glue Fix by text message will be counted as one (1) entry. Standard text messaging rates, terms, and conditions apply and may not be available from all service providers or for all handsets. Other charges may also apply. Participants should check with their service provider for details.
All entries must be received by 11:59pm ET on December 31, 2013. Incomplete entries, or those containing incorrect information, will be void. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the Entrant. All entries become the property of Sponsor and may not be acknowledged or returned.
Limits on number of entries. Each Krazy Glue Fix may be entered through each of the four methods of entry (website, Twitter, Instagram and text message) and will be counted as a separate Entry. However, each Krazy Glue Fix may only be submitted once through each of the four methods of entry. For example, you may submit a picture of your Krazy Glue Fix through Twitter and through Instagram and it will count as two (2) Entries, but you may not submit a picture of your Krazy Glue Fix more than one time through Twitter or any of the other means of entry. Only one Entry per Krazy Glue Fix per means of entry.
LIMITATIONS OF LIABILITY: The Released Parties shall not be responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. Sponsor is not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, service providers including Twitter or Instagram, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor is not responsible for any typographical or other errors in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this promotion. In the event Sponsor is prevented from awarding prizes or continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state or local government law, order or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a "Force Majeure" event or occurrence), then Sponsor shall have the right to modify, suspend or terminate the Sweepstakes. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Prizes: There will be up to one (1) Grand Prize and ten (10) Monthly Prizes awarded. The Grand Prize winner, upon proper verification and full compliance with these Official Rules, will receive a cash prize up to $40,000. Grand Prize determination will depend on the number of Krazy Glue Fixes submitted:

The approximate retail value of all prizes is $14,227.93 - $44,227.93 depending on the value of the Grand Prize.
No other substitution or transfer of prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute the prize with another prize of equal or greater value in the event that the aforementioned prize is not available. Odds of winning depend on the number of eligible entries received during the Entry Period.
Drawing and Notification: The Grand Prize and Monthly Prize winners will be selected by a random drawing from among all eligible entries received. The drawing will be conducted by the Administrator whose decisions are final in all matters relating to this Sweepstakes. The Grand Prize drawing will be completed on or about January 5, 2014. Administrator shall conduct drawings for the Monthly Prize winners on the 5th of each month, or the next business day if the 5th of the month falls on a weekend or holiday, beginning on April 5, 2013. Only entrants who submit an eligible entry during the month immediately preceding a drawing for a Monthly Prize will be eligible for that Monthly Prize. For example, only eligible entries received during the month of April will be entered into the drawing on May 5, 2013. All eligible entries regardless of the month of submission will be entered into the Grand Prize drawing. Odds of winning will depend on the total number of eligible entries received. Winner will be notified by Sponsor or Administrator by the contact information provided in connection with the Entry which may vary depending on the means of entry. Upon initial notification of winners, and verification of winner's eligibility, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor's or Administrator's choice. All prize winners are responsible for all applicable federal, state and local taxes and/or any other fees/costs associated with the prize or receipt of the prize. An I.R.S. Form 1099 may be issued to the prize winners for the approximate retail value of the prize awarded.
All Prize winners will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (unless prohibited) within ten (10) business days of notification. Winner's failure to timely return the Affidavit of Eligibility and Liability/Publicity Release may result in winner's disqualification at Sponsor's or Administrator's sole discretion. In the event of noncompliance with the Official Rules, if a potential winner cannot be reached through the contact information provided with winner's entry or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected. The winner's entry and acceptance of the prize constitutes permission (except where prohibited) for the Sponsor to use said winner's entry and winner's name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
Other Terms & Conditions: CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. The Sweepstakes is subject to all applicable federal, state, and local laws. In the event of a dispute regarding the identity of an individual who submitted an entry, the entry will be deemed submitted by the authorized account holder of the phone number or email account associated with the entry or the Twitter/Instagram account through which the entry was submitted. "Authorized account holder" shall be defined as the natural person who is assigned to an email/Twitter/Instagram account or phone number by the respective service provider. Selected winner may be required to show proof of being the authorized account holder. Sponsor reserves the right, in its sole discretion, to disqualify any entry and to modify, terminate or suspend this Sweepstakes should virus, bugs, non-authorized human intervention, action of Entrants, or other causes beyond the reasonable control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Sweepstakes and, if the Sweepstakes is modified, terminated or suspended, at Sponsor's discretion, select winners from those eligible, non-suspect entries. Winners further acknowledge that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the Sweepstakes or any prize, including, but not limited to, its quality or fitness for a particular purpose.
USE OF DATA: Sponsor will collect personal data about Entrants including e-mail addresses associated with entries in accordance with its Privacy Policy. Please review the Sponsor's Privacy Policy at the following link: http://www.krazyglue.com/privacy/. By participating in the Sweepstakes and providing your e-mail address, Entrants hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's Privacy Policy.
DISPUTES: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Ohio. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio
